Last updated: July 30, 2026
1. Overview
This website is operated by Jessica’s Collection.
Throughout these Terms and Conditions, the words “Jessica’s Collection,” “we,” “us” and “our” refer to Jessica’s Collection. The words “you” and “your” refer to any person who visits our website, creates an account or purchases a product from us.
These Terms and Conditions govern your access to and use of our website, online store, products and related services, collectively referred to as the “Services.”
By visiting our website, creating an account, placing an order or otherwise using our Services, you confirm that you have read, understood and agreed to these Terms and Conditions, together with our:
- Privacy Policy
- Return and Refund Policy
- Shipping Policy
- Any other policy or notice displayed on our website
Please do not use the website or place an order if you do not agree to these terms.
Nothing in these Terms and Conditions excludes or limits a consumer right that cannot lawfully be excluded or waived.
2. Contact Information
Questions about these Terms and Conditions may be sent to:
Jessica’s Collection
Ottawa, Ontario, Canada
Email: info@jessicas-collection.com
A complete legal business name and physical or mailing address should be added before publication.
3. Eligibility to Use the Website
By using our website, you confirm that:
- You have reached the age of majority in your province, state or country of residence; or
- You have permission from a parent or legal guardian to use the website.
You may not use our Services for an unlawful, fraudulent or unauthorized purpose.
You are responsible for ensuring that your use of the website complies with the laws that apply in your location.
4. Changes to These Terms
We may update these Terms and Conditions when our Services, business practices or legal obligations change.
The updated version will be published on this page with a revised “Last updated” date. Changes will apply from the date they are published unless another effective date is stated.
Changes will not retroactively alter an order that was already accepted unless required by law or agreed to by both parties.
Your continued use of the website after an updated version is published means that the revised terms will apply to your future use of the Services.
5. Website Availability
We aim to keep our website available, accurate and secure. However, we do not guarantee that access will always be uninterrupted or free from technical problems.
We may temporarily restrict, suspend or discontinue all or part of the website when reasonably necessary for:
- Maintenance
- Security
- Technical updates
- Service improvements
- Legal or regulatory reasons
- Events outside our reasonable control
We may also introduce, change or remove website features.
6. Account Registration
Some website features may require you to create an account.
When creating or using an account, you agree to:
- Provide complete and accurate information.
- Keep your information current.
- Protect your password and login credentials.
- Notify us promptly if you suspect unauthorized access.
- Accept responsibility for activity conducted through your account, except where the activity resulted from circumstances outside your reasonable control.
You may not impersonate another person, create an account using false information or use someone else’s account without permission.
We may suspend or close an account where we reasonably believe that it has been used unlawfully, fraudulently or in violation of these terms.
7. Product Information
We take reasonable steps to describe and display our products accurately.
Product listings may include information about:
- Colour
- Size
- Fit
- Material
- Features
- Availability
- Care instructions
- Price
Colours may appear differently depending on your screen, device settings and lighting conditions. Minor differences between website images and the delivered product do not necessarily indicate a defect.
Measurements and sizing information are approximate unless expressly stated otherwise. Please review the relevant size guide before ordering.
We may correct product descriptions, images, availability information or other listing details where an error is identified.
8. Product Availability
Products may be available in limited quantities.
Adding a product to your shopping cart does not reserve that product. Availability is only confirmed when your order is accepted.
We may:
- Set reasonable purchase limits.
- Discontinue products.
- Limit availability by region.
- Refuse purchases that appear intended for unauthorized resale.
- Cancel an unavailable item and issue the appropriate refund.
If an item becomes unavailable after you place an order, we will contact you and refund the amount paid for that item.
9. Prices and Currency
Unless otherwise stated, prices displayed on our website are shown in Canadian dollars (CAD).
Prices may change without prior notice. A price change will not normally affect an order that has already been accepted.
Applicable taxes, shipping charges and other mandatory costs will be displayed before you complete your purchase, where required.
We do not intentionally add hidden mandatory fees to an advertised price. Under Canadian competition law, advertising a price that cannot actually be obtained because of later mandatory non-government charges may constitute prohibited drip pricing.
Customs duties, import taxes and government charges may apply to international shipments. Where such charges are not collected during checkout, they may be payable directly to the applicable authority or carrier.
10. Promotions and Discount Codes
Promotions, sale prices and discount codes may be subject to separate conditions.
Unless stated otherwise:
- Promotions cannot be combined.
- Discount codes must be entered before completing checkout.
- Discounts cannot be applied retrospectively.
- Promotions may have geographic, product or time restrictions.
- Some products may be excluded.
- Promotions have no cash value.
- Only one promotional code may be used per order.
- We may cancel promotions affected by fraud, misuse or a genuine technical error.
Promotional claims and savings representations will be presented in accordance with applicable law.
11. Placing an Order
You can place an order by selecting a product, adding it to your cart and completing the checkout process.
Before submitting your order, you are responsible for reviewing:
- The selected products.
- Sizes, colours and quantities.
- Billing information.
- Shipping information.
- The total price.
- Applicable taxes and disclosed charges.
- The available payment method.
- The relevant store policies.
By selecting the final purchase button, you submit an offer to purchase the products in your order.
12. Order Confirmation and Contract Formation
After you place an order, we will normally send an automated confirmation email.
This initial email confirms that we received your order. It does not necessarily mean that the order has been accepted.
A purchase contract is formed when we:
- Send an order-acceptance or shipping confirmation; or
- Begin fulfilling or shipping the order,
whichever occurs first.
We may refuse or cancel an order before acceptance for legitimate reasons, including:
- A product is unavailable.
- Payment authorization fails.
- The information provided appears incorrect.
- Fraud or unauthorized activity is suspected.
- A pricing or product-listing error occurred.
- Delivery is unavailable for the supplied address.
- The order violates a purchase limitation.
- The order appears to be placed for unauthorized resale.
If we cancel an order after payment was collected, we will refund the affected amount to the original payment method.
For qualifying Ontario online transactions, consumers must receive specified information and a copy of the agreement. Ontario guidance states that the confirmation page should show an itemized purchase list before payment and that a final receipt must be provided within the applicable period.
13. Errors in Prices or Product Listings
Occasionally, a product listing may contain an obvious pricing, description, availability or technical error.
Where an error is identified before the order is accepted, we may:
- Correct the information.
- Contact you for confirmation.
- Refuse or cancel the affected order.
Where an order has already been accepted, we will handle the error reasonably and in accordance with applicable consumer law.
We will not replace the stated price with a higher price without giving you an opportunity to review and accept the change.
14. Payment
Available payment methods will be displayed during checkout.
By submitting payment information, you confirm that:
- The information is complete and accurate.
- You are authorized to use the selected payment method.
- Sufficient funds or credit are available.
- The transaction does not violate applicable law.
Payments may be processed by third-party payment providers. Those providers may conduct fraud, identity or authorization checks in accordance with their own terms and privacy policies.
We generally do not directly store complete payment-card information.
15. Fraud Prevention
We may take reasonable steps to verify an order before acceptance or shipment.
This may include requesting:
- Confirmation of account information.
- Confirmation of the billing or shipping address.
- Additional payment authorization.
- Limited identity verification where reasonably necessary.
We may delay, refuse or cancel an order where we reasonably suspect fraud, unauthorized payment activity or misuse of the website.
Any personal information used for verification will be handled in accordance with our Privacy Policy.
16. Shipping and Delivery
Order processing, estimated delivery times, shipping charges and tracking information are described in our Shipping Policy.
Our products may be processed or shipped through third-party fulfilment partners, including facilities outside Canada.
Estimated delivery dates are not guaranteed unless expressly stated otherwise.
Delivery may be affected by:
- Carrier delays
- Customs inspections
- Severe weather
- Peak shopping periods
- Public holidays
- Incorrect addresses
- Events outside our reasonable control
Mandatory consumer rights concerning late or failed delivery remain unaffected.
17. Customs and Import Charges
International orders may be subject to:
- Customs duties
- Import taxes
- Brokerage fees
- Clearance charges
- Other government-imposed costs
Unless checkout expressly states that these charges have been collected, they are the customer’s responsibility.
We do not control the amount charged by customs authorities or carriers.
Customers are responsible for determining whether ordered products may lawfully be imported into their destination country.
18. Incorrect Delivery Information
You are responsible for providing a complete and accurate delivery address.
Please contact us immediately after ordering if you notice an error. We will try to assist, but we cannot guarantee that information can be changed after fulfilment has begun.
Additional costs may apply where an order must be redirected or resent because the customer supplied an incorrect or incomplete address.
19. Refused and Unclaimed Packages
Where an order is refused, left unclaimed or returned because of incorrect delivery information, we may deduct reasonable and documented return, shipping and processing costs from any refund, where permitted by law and previously disclosed.
A deduction of up to $35 CAD may apply in accordance with our Return and Refund Policy.
We will not impose this deduction where the return resulted from our error, a verified defect or another circumstance for which we are legally responsible.
20. Returns and Refunds
Returns, refunds, cancellations, damaged products and exchanges are governed by our Return and Refund Policy.
Customers must follow the authorized return procedure and wait for return instructions before shipping a product.
Nothing in our voluntary return policy replaces mandatory rights relating to defective, unsafe, incorrectly described or otherwise non-compliant products.
21. Product Warranties
Products may be protected by statutory rights or an applicable manufacturer’s warranty.
Where a warranty is offered, its duration, coverage and exclusions will be described with the product or in separate warranty information.
We will not make a warranty or guarantee representation unless there is a reasonable basis to honour it. Canadian competition law prohibits materially misleading warranty and guarantee claims.
22. Product Safety and Recalls
We aim to offer products that comply with applicable product-safety requirements.
We may remove a product, contact affected customers or cooperate with a recall where a safety concern is identified.
You agree to stop using a product and follow the provided instructions if we or a relevant authority issue a safety notice or recall.
23. Personal Information
Personal information submitted through the website is handled in accordance with our Privacy Policy.
By using the website, you acknowledge that information may be processed by service providers that support functions such as:
- Hosting

Please review our Privacy Policy for additional information about collection, use, storage and disclosure.
24. Third-Party Services and Tools
We may give you access to services, applications or tools supplied by third parties.
Examples may include:
- Payment providers

- Review platforms
- Social-media functions
- Customer-support software
- Analytics services
Third-party services may be governed by separate terms and privacy policies.
We do not control those services and are not responsible for their independent operation, content or privacy practices, except to the extent required by law.
Your use of an optional third-party service is at your own discretion.
25. External Links
Our website may contain links to websites operated by other organizations.
A link does not necessarily mean that we endorse or control the external website.
We are not responsible for the availability, content, security, products or privacy practices of third-party websites.
Please review the applicable terms and policies before completing a transaction through an external website.
26. Reviews, Feedback and User Content
You may choose to submit reviews, photographs, comments, suggestions or other content.
You confirm that content you submit:
- Is accurate and based on your genuine experience.
- Does not violate another person’s copyright, trademark or privacy rights.
- Is not defamatory, threatening, obscene, discriminatory or unlawful.
- Does not contain malware, spam or misleading information.
- Does not impersonate another person.
- Does not include confidential information that you are not authorized to disclose.
For content intentionally submitted for public display, you grant Jessica’s Collection a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for operating and promoting our Services.
You retain ownership of your original content.
We may moderate or remove content that violates these terms, is irrelevant, is fraudulent or creates legal or security risks.
Private messages sent to customer support will not be treated as public promotional content merely because they were submitted to us.
27. Intellectual Property
Unless otherwise stated, the website and its content belong to Jessica’s Collection or are used under licence.
Protected content may include:
- Logos
- Brand names
- Product photography
- Text
- Graphics
- Website designs
- Videos
- Icons
- Software
- Product descriptions
You may use the website for personal, non-commercial shopping purposes.
Without prior written permission, you may not:
- Copy or republish substantial website content.
- Use our branding to suggest an unauthorized relationship.
- Sell or commercially exploit website materials.
- Remove copyright or trademark notices.
- Scrape or systematically extract website data.
- Reverse-engineer protected website technology.
- Create unauthorized derivative works.
28. Prohibited Conduct
You may not use the website or Services to:
- Break any applicable law.
- Commit fraud or facilitate unauthorized transactions.
- Infringe intellectual-property rights.
- Harass, threaten or unlawfully discriminate against others.
- Submit false or misleading information.
- Distribute malware or harmful code.
- Attempt unauthorized access to accounts, systems or data.
- Interfere with website security or operation.
- Collect personal information about others without authorization.
- Send spam, phishing messages or deceptive communications.
- Use automated tools to scrape the website without permission.
- Manipulate reviews, promotions or pricing.
- Place orders for unauthorized resale.
- Circumvent purchasing or geographic restrictions.
- Engage in conduct that could harm Jessica’s Collection, its customers or service providers.
We may restrict or terminate access where these rules are violated.
29. Suspension and Termination
You may stop using our Services at any time.
We may suspend or terminate your access where:
- You materially breach these Terms and Conditions.
- You engage in fraudulent or unlawful activity.
- Your use creates a security risk.
- We are required to do so by law.
- We discontinue the relevant Service.
Where reasonable, we will give notice or an opportunity to address the problem before termination.
Termination does not affect:
- Rights and obligations that arose before termination.
- Outstanding payment obligations.
- Provisions that are intended to continue, including intellectual-property, liability and dispute provisions.
30. Disclaimer Regarding Website Operation
We take reasonable steps to maintain the website and provide accurate information.
However, to the fullest extent permitted by law, we do not guarantee that:
- The website will always be available.
- Every technical error will be corrected immediately.
- The website will be completely free from harmful components.
- Information supplied by third parties will always be accurate.
- The website will work with every device or browser.
These limitations do not affect any express promise made in an accepted order or any mandatory consumer right.
31. Limitation of Liability
Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or another matter for which exclusion is prohibited.
To the maximum extent permitted by law, Jessica’s Collection will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the contract was formed.
Where liability may lawfully be limited, our total liability arising from a particular order will not exceed the amount paid for the affected product or order.
This limitation does not reduce any statutory remedy available for a defective product, misleading representation, breach of consumer law or other non-excludable right.
32. Indemnification
To the extent permitted by law, you agree to compensate Jessica’s Collection for reasonable losses, liabilities and expenses resulting directly from:
- Your unlawful use of the website.
- Your intentional infringement of another party’s rights.
- Content you submit in violation of these terms.
- Fraudulent conduct committed through your account.
This section does not require you to indemnify us for losses caused by our own negligence, breach of contract or unlawful conduct.
33. Events Outside Our Control
We will not be responsible for delay or failure caused by an event outside our reasonable control, including:
- Natural disasters
- Severe weather
- War or civil unrest
- Government action
- Labour disputes
- Transportation interruptions
- Customs disruptions
- Widespread internet or power failures
- Public-health emergencies
- Supplier or carrier failures outside our reasonable control
We will take reasonable steps to reduce the effect of such an event and resume performance where possible.
Your mandatory rights relating to cancellation, delivery or refunds remain unaffected.
34. No Waiver
If we do not immediately enforce a provision of these Terms and Conditions, that does not mean we have waived the provision or our right to enforce it later.
A waiver is only effective when clearly confirmed in writing.
35. Severability
If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply.
36. Assignment
You may not transfer your rights or obligations under an accepted order without our written permission.
We may transfer our rights or obligations as part of a legitimate business reorganization, sale or transfer, provided that doing so does not reduce your mandatory consumer rights.
37. Entire Agreement
These Terms and Conditions, together with the policies expressly incorporated into them and the information shown during checkout, form the agreement between you and Jessica’s Collection concerning your use of the Services and purchases made through the website.
They replace prior discussions or communications concerning the same subject, except for representations or rights that cannot legally be excluded.
38. Governing Law
These Terms and Conditions and purchases made through our website are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
Any dispute will be submitted to a court or authority with lawful jurisdiction.
Nothing in this section prevents a consumer from relying on mandatory protections available under the laws of their province, territory or country of residence where those protections legally apply.
39. Dispute Resolution
If you experience a problem with an order, please contact us first at:
Include your name, order number and a clear description of the issue.
We will make a reasonable effort to investigate and resolve the matter fairly.
Contacting us does not remove your right to contact a payment provider, consumer-protection authority or court where appropriate.
40. Changes to Products or Services
We may update, replace or discontinue a product or website feature.
We will not make a material change to an accepted order without your agreement unless:
- The change is required by law.

- The original product is unavailable and you agree to an alternative.
Where we cannot fulfil an accepted order, we will provide an appropriate refund.
